“service(s)” – means any service offered by Eloquent Learning Health or its business partners, any service described in these terms and conditions, consultations services, knowledge sharing, and any other service that you may subscribe to or which may form part of Eloquent Learning Health’s offering from time to time;
Nature of information on the site
All information on this site is only intended to provide you with information about Eloquent Learning Health, their clients, their members, their business partners, their products, services and objectives. Nothing on this site should be treated as an offer but merely as an invitation to do business with us.

Online course enrolment and access
When you enrol in an online course or other content, Eloquent Learning Health grants you (as a student) a limited, non-exclusive, non-transferable license to access and view the content for which you have paid all required fees, solely for your personal, non-commercial, educational purposes through the Services, in accordance with these Terms and any conditions or restrictions associated with the particular content or feature of our Services. All other uses are expressly prohibited. We generally give a one-year access license to our students when they enroll in a course or other content. However, we reserve the right to revoke any license to access and use any content at any point in time in the event where we decide or are obligated to disable access to the content due to legal or policy reasons, for example, if the course or other content you enrolled in is the object of a copyright complaint. This one-year access license does not apply to enrolments via Subscription Plans or to add-on features and services associated with the course or other content you enrol in. For example, Eloquent Learning Health and its instructors may decide at any time to no longer provide teaching assistance or Q&A services in association with the content. To be clear, the one-year access is to the course content but not to the instructor.
Enrolment and attendance of classroom courses
When you enrol in a classroom-based course presented and hosted by Eloquent Learning Health, you agree to adhere to all terms and conditions outlined in this agreement.
Attendance is mandatory for all scheduled sessions of the enrolled classroom-based courses. Participants are responsible for ensuring their punctuality and participation in all course activities.
Participants must adhere to Eloquent Learning Health’s cancellation and refund policy, as specified in this agreement, or as communicated by Eloquent Learning Health representatives.
All intellectual property rights, including but not limited to copyrights, trademarks, trade secrets, and any other proprietary information related to the classroom-based courses, materials, and content provided by Eloquent Learning Health, remain the exclusive property of Eloquent Learning Health.
Participants acknowledge that the course materials and content provided are solely for their personal educational use. Any unauthorised reproduction, distribution, or public display of these materials is strictly prohibited.
Participants agree not to disclose, reproduce, or distribute any course materials or content, in whole or in part, to any third party unless we give you explicit permission to do so in a written agreement signed by an Eloquent Learning Health authorised representative.
Eloquent Learning Health grants participants a limited, non-exclusive, non-transferable license to use course materials solely for personal educational purposes. This license does not confer any rights to modify, reproduce, or distribute the materials beyond the scope of the course.
Eloquent Learning Health reserves the right to take appropriate legal action, including but not limited to the termination of course enrolment, seeking injunctive relief, and pursuing damages, in the event of any violation of these terms related to enrolment, attendance, or intellectual property.
By enrolling in a classroom-based course presented and hosted by Eloquent Learning Health, participants acknowledge and agree to the terms outlined in this clause.
Limited License to General Users
The Eloquent Learning Health Website and the content may not be reproduced, duplicated, copied, resold, visited or otherwise exploited for any commercial purpose without the express prior written consent of an Eloquent Learning Health authorised representative.
The license does not allow the User to collect product or service listings, descriptions or other information displayed here.
Eloquent Learning Health grants to the User, subject to the further terms of these Terms and Conditions, a non-exclusive, non-transferable, limited, and revocable right to access, display, use, download and otherwise copy the current and future Content for personal, non-commercial and information purposes only.
The User may not frame nor use framing technologies to enclose the Website or the Content nor any part thereof without the consent of Eloquent Learning Health.

Payment may be made via Visa or MasterCard or by bank transfer into the Eloquent Learning Health bank account, the details of which will be provided on request
Card acquiring and security
Card transactions will be acquired for Eloquent Learning Health via the InstaPay WebPay service provided by Omnea (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. Omnea (Pty) Ltd uses PCI/DSS compliant services and no Card details are stored on the website. Users may go to www.omnea.co.za to view their security policy.

Enrollment Confirmation

Classroom courses and non-online services
Cancellation by Participant
Participants may cancel their enrollment in a classroom course or any non-online service by notifying Eloquent Learning Health in writing (via email or a written letter).
Cancellation Period:
- Full refund: Cancellations made 14 calendar days or more before the start of the course.
- Partial refund: Cancellations made 7 calendar days or more before the start of the course, subject to a 50% of course fee deduction for administrative, processing and preparation fees.
No refunds will be issued for cancellations made within 7 days of the course start date.
Course Postponement or Cancellation by Eloquent Learning Health
Eloquent Learning Health reserves the right to postpone or cancel a course due to unforeseen circumstances, such as low enrollment, instructor unavailability, or other logistical issues.
In such cases, participants will be notified promptly, and they may choose to transfer their enrollment to a future course or receive a full refund.
Online couses and services
No refunds will be issued for cancellations of online courses or services.
Refund Process
Refunds will be processed using electronic funds transfer (EFT) payment method only.
Refund amounts will be calculated based on the cancellation policy outlined above.
Course Materials and Access
In the event of participant cancellation, access to course materials and online resources will be revoked.
Exceptions
Eloquent Learning Health may consider exceptions to this policy in exceptional circumstances, such as medical emergencies. Participants must provide appropriate documentation to be eligible for consideration.
